Overview

MaxiDrives is an online service provider and implements a notice-and-takedown procedure consistent with the DMCA. In most cases, we aim to act within 24 hours of receiving a proper notice; timing may vary depending on the volume and verification required. This page guides rights holders on submitting a notice and users on submitting a counter-notice if content was removed by mistake.

How to File a DMCA Notice

To request removal of allegedly infringing material, your notice must include all items below:

  • Identity & signature: Your full name and role (owner or authorized agent) and a physical or electronic signature.
  • Work(s) identified): Describe the copyrighted work(s) you believe are infringed.
  • Infringing material: Provide the exact MaxiDrives URL(s) where the material appears.
  • Contact details: Name, postal address, phone number, and business email address.
  • Good-faith statement: “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
  • Accuracy & authority: “The information in this notice is accurate, and under penalty of perjury, I am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”

Notice & Takedown Process

  • Upon receipt of a proper notice, MaxiDrives may remove or disable access to the material and notify the uploader.
  • We generally act within 24 hours where feasible; some cases may require additional verification time.
  • If we remove content, the uploader may submit a counter-notice as described below.

Counter-Notice (Restore Content)

If you believe your material was removed due to a mistake or misidentification, you may submit a counter-notice containing:

  • Identification of material: Describe the material removed and provide its MaxiDrives URL before removal.
  • Contact details: Your name, address, and phone number.
  • Good-faith statement: “I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.”
  • Jurisdiction consent: “I consent to the jurisdiction of the courts at my address, and will accept service of process from the person who provided the notice or their agent.”
  • Signature: Physical or electronic signature of the account holder.

Repeat Infringers

MaxiDrives may, in appropriate circumstances and at its discretion, terminate accounts of users who are repeat infringers. This may include limiting access to the Service and removing content.

Misuse of DMCA

Submitting fraudulent or bad-faith notices/counter-notices may have legal consequences. Use the DMCA process responsibly and only for claims you are authorized to make.

Tips for Faster Handling

  • Include direct MaxiDrives file URLs (not screenshots or third-party mirrors).
  • Send the notice from a verifiable business domain (e.g., rights holder or law firm).
  • Bundle multiple URLs for the same work in one notice; separate unrelated works into separate notices.
